The key terms of the warranty for Autel EV Chargers supplied by Future Charging Solutions Pty Ltd are as follows:
(a) In Australia, our goods come with guarantees which cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
(b) In addition to any other rights you may have under the Australian Consumer Law, we warrant that the Autel EV Charger supplied by us will be free from defects for the warranty period specified in the applicable Autel warranty documentation supplied with the product (Warranty).
(c)What is a Defect? Our Warranty applies to any fault, error or defect in the product arising by reason of defective workmanship or materials under normal use and operating conditions (Defect).
(d)What do you need to do to claim the Warranty? Within the Warranty period, if you believe your Autel EV Charger is the subject of a Defect, you must cease using the product where appropriate and contact us in writing together with photographs and/or video evidence and a description of the Defect. If requested, you must return the defective product together with all packaging, parts, accessories, documentation and proof of purchase to the contact details provided by Future Charging Solutions.
(e) Where you return a product as part of a Defect claim, you will need to cover any associated costs of returning the product to us. Where we determine the product is covered by our Warranty, we will reimburse the reasonable costs of returning the product.
(f) When we receive the returned product, we will assess the alleged Defect and determine whether the claim is valid under this Warranty.
(g)What will we do if you make a successful claim under our Warranty?
We will, at our own cost:
Repair or replace the product (the decision whether to repair or replace is at our sole discretion); or
If we are unable to repair or replace the product, we will offer you a choice of a credit, refund or compensation as applicable under the Australian Consumer Law.
(h)Damage not covered by our Warranty. The Warranty does not cover any Defect which is caused (or partly caused) or contributed to by any:
Reasonable wear and tear;
Act or omission, accident or negligence by you or any third party not engaged by us (including any third-party installer);
Failure to follow any installation, operating or maintenance instructions or guidelines supplied by Future Charging Solutions or Autel;
Use of the product other than for the application or purpose specified by Future Charging Solutions or Autel;
Continued use of the product after any Defect becomes apparent, or would have become apparent to a reasonably prudent person, where such continued use results in further damage;
Incorporation of, or connection to, incompatible equipment, accessories or other products;
Failure to notify us of any Defect within a reasonable period after becoming aware, or reasonably ought to have become aware, of the Defect; or
Installation, repair, replacement, maintenance, alteration, modification, servicing or other work carried out by any person other than Future Charging Solutions, Autel or an authorised service provider.
Australian Consumer Law
(a) We do not accept returns for change of mind or other circumstances. However, you may have rights to a repair, replacement or refund under the Australian Consumer Law.
(b) Nothing in these Warranty Terms attempts to modify or exclude the conditions, warranties, guarantees or other legal rights available under the Australian Consumer Law. Any warranties that are not guaranteed by the Australian Consumer Law are excluded only to the extent permitted by law.
(c) Where you return products to us to seek a remedy under the Australian Consumer Law, you will initially be responsible for any associated costs (including freight) of returning the products to us.
(d) Where your claim is determined to be valid under the Australian Consumer Law, we will reimburse your reasonable return delivery costs and, depending on the nature of the failure, repair or replace the product, or provide a refund or other remedy as required under the Australian Consumer Law.
