EVSE EV Charger – Warranty Terms and Conditions
The key terms of the warranty for EVSE EV Chargers supplied by Future Charging Solutions Pty Ltd are as follows:
(a) Australian Consumer Law
In Australia, our goods come with guarantees which cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
(b) Product Warranty
In addition to any other rights you may have under the Australian Consumer Law, we warrant that the EVSE EV Charger supplied by us will be free from defects for the warranty period specified in the applicable EVSE warranty documentation supplied with the product (Warranty).
The standard warranty period is 2 years, with an option to extend the warranty up to 5 years at an additional cost, where available and confirmed at the time of purchase.
(c) What is a Defect?
Our Warranty applies to any fault, error or defect in the product arising by reason of defective workmanship or materials under normal use and operating conditions (Defect).
(d) What do you need to do to claim the Warranty?
Within the Warranty period, if you believe your EVSE EV Charger is subject to a Defect, you must cease using the product where appropriate and contact us in writing, providing photographs and/or video evidence and a description of the Defect.
If requested, you must return the defective product, together with any relevant parts, accessories, documentation and proof of purchase, to the contact details provided by Future Charging Solutions. Original packaging should be included where reasonably available but is not mandatory for claims under the Australian Consumer Law.
(e) Return Costs
Where you return a product as part of a Defect claim, you may initially need to cover reasonable costs associated with returning the product to us, where permitted by law.
Where the product is confirmed to be defective and covered under the Warranty or Australian Consumer Law, we will reimburse reasonable return costs. Where applicable, Future Charging Solutions will arrange or cover the return of large, heavy or difficult-to-remove products in accordance with the Australian Consumer Law.
(f) Warranty Assessment
When we receive the returned product, we will assess the alleged Defect and determine whether the claim is valid under this Warranty.
Where necessary, we may coordinate with EVSE or its authorised representatives to assess the Defect and determine the appropriate remedy.
(g) What will we do if you make a successful claim under our Warranty?
We will, at our own cost:
Repair or replace the defective product, at our discretion under the express Warranty, subject to your statutory rights; or
If repair or replacement is not possible, offer an appropriate credit, refund or compensation, subject to the remedies and rights available under the Australian Consumer Law.
Nothing in this clause limits your right to choose a refund or replacement where the Australian Consumer Law provides that choice.
(h) Damage Not Covered by Our Warranty
To the extent permitted by law, the Warranty does not cover any Defect caused or contributed to by:
Normal wear and tear;
Accidental damage, misuse, negligence or improper handling by you or a third party;
Failure to follow installation, operating, safety or maintenance instructions supplied by Future Charging Solutions or EVSE;
Use of the product outside its intended application, rated electrical capacity or specified operating conditions;
Continued use of the product after a Defect becomes apparent, where such continued use causes further damage;
Connection to incompatible equipment, electrical outlets, adaptors, accessories or other products;
Failure to notify Future Charging Solutions of a Defect within a reasonable period after becoming aware of it, where the delay causes additional damage;
Unauthorised repairs, alterations, modifications or servicing that cause or contribute to the Defect;
Damage caused by power surges, incorrect voltage, electrical faults or inadequate electrical supply, where not attributable to a defect in the product; or
Physical damage caused by improper storage, transport or exposure to environmental conditions beyond the manufacturer's specifications.
These exclusions apply to the express Warranty only and do not exclude or restrict rights available under the Australian Consumer Law.
Australian Consumer Law
(a) Future Charging Solutions does not generally accept returns for change of mind. However, customers retain all applicable rights to repair, replacement, refund or other remedies under the Australian Consumer Law.
(b) Nothing in these Warranty Terms attempts to modify, restrict or exclude the conditions, warranties, guarantees or other legal rights available under the Australian Consumer Law. Any exclusions or limitations apply only to the extent permitted by law.
(c) Where you return products to us to seek a remedy under the Australian Consumer Law, you may initially be responsible for reasonable return costs where permitted by law.
(d) Where your claim is determined to be valid under the Australian Consumer Law, we will reimburse reasonable return delivery costs and, depending on the nature of the failure, repair or replace the product, provide a refund or offer another remedy as required by law.
(e) Your rights under the Australian Consumer Law may continue beyond the manufacturer's stated warranty period.
